These Terms of Service ("Terms") govern your access to and use of the corporate website at proximax.ai (the "Site"), operated by PROXIMAX AI ("PROXIMAX," "we," "our," "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Scope

These Terms apply only to the Site. Our productsTACOSAI (cloud filmmaking platform) and Omega (private on-prem deployment)are governed by separate terms presented at sign-up or deployment, including any applicable subscription, licensing, or master service agreements.

Use of the Site

You may access and view the Site for informational purposes. You agree not to:

  • Use the Site in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to systems, data, or user accounts
  • Scrape, mirror, or systematically extract content for commercial purposes without prior written permission
  • Reverse-engineer or attempt to derive source code or proprietary methods
  • Introduce malware or any code that disrupts the Site's operation
  • Use automated bots that impose excessive load on the Site

Intellectual Property

All content on the Siteincluding text, graphics, design, layout, code, the PROXIMAX AI wordmark, the TACOSAI and Omega names and marks, and the concept stills displayed in the Showcase sectionis the property of PROXIMAX AI or its licensors and is protected by copyright, trademark, and other intellectual property laws.

The concept stills displayed on this Site are originals generated through the TACOSAI pipeline. Titles shown alongside them are in-house concepts and do not represent commercially released films.

You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from Site content without our prior written permission.

Your Work, Your IP

Content created by users through our products (TACOSAI and Omega)including films, images, audio, scripts, footage, and any other creative outputbelongs to the user who created it. PROXIMAX AI does not claim ownership of any user-generated work produced through our products. The IP stays with its makers.

Specific licensing termsincluding any limited operational license users grant us solely to host, display, or process their work for the purpose of providing the serviceare set out in the product agreements presented at sign-up or deployment. In the event of any conflict between these Site Terms and a product agreement on the question of user-created IP, the product agreement controls.

The Site contains links to external websites, including tacosai.com. We do not control and are not responsible for the content, privacy practices, or terms of any third-party sites. Following such links is at your own risk.

TO THE FULLEST EXTENT PERMITTED BY LAW, PROXIMAX AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to defend, indemnify, and hold harmless PROXIMAX AI from claims, damages, or expenses arising out of your unlawful use of the Site or your violation of these Terms.
